'double baulked'

I am really confused what if your opponent fouls and leaves you 'double baulked' it would seem unfair if u still had to play out of baulk first.

if your not happy because he fouled you can make him go again from where the ball lies

After any foul at billiards ,wherever the balls are the incoming player can have the balls spotted (or play the balls as they are).
IE Red on the spot,white on the centre spot and cue ball in hand. This is regarded as a good position for a billiard player.
You can't make him go again as in snooker.

If you are double-baulked, you do still have to play out of baulk. However, you are not called foul if you fail to hit an object ball. It is a "Miss" and is still two points away, but because it is not a foul your opponent cannot then have the balls spotted.

Therefore, the usual thing to do is to just play your cue-ball out of baulk to what you consider a reasonably unattractive position for your opponent - safe in the knowledge that he cannot have the balls spotted.

Footnote:
Because after a "foul" the oncoming player can have the balls spotted, and after a "Miss" he cannot, you have to remember that the two words Foul and Miss are treated almost the opposite way round to in snooker!

Sorry yes, I didn't see that in the opening post.

Yes if you are double-baulked after a foul, YOU can have the balls spotted for your next shot. If you choose to play from where the balls are, then my above response takes effect.

Double baulked after a foul

All the answers are correct. However what would decide whether you played safe ie a miss to somewhere safe would depend on where the balls were in baulk. When we double baulk after potting the opponent we endeavour to leave the balls in a good scoring position which is why sometimes we play a miss or alternatively try to move the double baulked balls hoping we do not make the situation better for the opponent,
