Damaged Goods by post

Hey guys

I ordered a 3/4 case recently, it came today but its been damaged in the post, its dented the bottom of the case, so theres like a pretty big crack.

i've rang the dealer up, and they offer a replacement, but is there any point really, i was just looking at parcelforce's delievery rate,

It's £14.99 to deliever it back to the dealer... the cue case cost be 27 incl P&P?
Its 2kg if anyone wanted to know.

It got me thinking, if i ever order goods that are damaged in post.. what the hell are you suppose to do if you can't cafford/ don't want to pay the cost of sending it back?

you can actually make a claim from Parcel force, assuming damage was not caused by poor packaging.

Under the Distance Selling Act, and under the Sale of Goods Act you have the right to return faulty items to the supplier. As long as the goods are faulty then you should not be out pocket. i.e. The supplier is liable for the return costs. This only applies to purchases from a business and only to faulty items.

Any statement of contract that contradicts this is in breach of your statutory rights. It is the supplier's responsibility to get your goods to you intact. They should be dealing with insurance or manufacturer claims. Many suppliers include statements like 'manufacturer's guarantee' or 'tracking details will be provided' to shift responsibility to the buyer, but these cannot override your legal rights.

This apart, where did it come from? Standard parcels rate for 2kg in the UK is £5.68 +£1 to insure up to £100. If your purchase was from overseas you will not have the same legal rights.

if you are in the uk its is the sellers problem to ensure it arrives in good order.

The seller is sending me another one, and they are claiming the insurance on the damaged good.

ste- i just looked on parcelforce and on their excel it showed 2kg as £14.99.
