  • Fake coutts cues website

It has been brought to our attention at coutts cue that there is a website couttscues.com based in china (our website is couttscues.co.uk) claiming to sell my cues. these cues are not my cues, they are fake and nothing to do with us at all, our agents in hong kong is eddie mok or perfect point only. These cues we believe are selling for alot more money despite being copies (much more than the genuine coutts cues) maybe to make them seem like the real thing. I am aware that most people on the snooker forum know my website is coutts cues.co.uk but would appreciate that this is past around to make as many people aware as possible especially those in hong kong and china

I can repost this thread and translate it in Chinese on some Chinese snooker forum. Do you want me to do so?

Looks like they've shut the sight already, but having looked at a cached copy of the page they've copied your cues and John Parris' page design. Hopefully it'll be gone for good now.

It's still on the Internet in Chinese. Looks like a Chinese company steal the brand and put it on.

Yes...it's still up and running. Pretty sly how they use "No.1 Lincoln" for your "No.55 London" . The rest of your trademark is much the same. Perhaps you can sue their a**** off for infringement!!

Second that. Bmw took a Chinese company to court after it built a car that was identical in every way, in fact this was featured on top gear, anyway the company denied it was anything like the bmw, if the badges had been removed it would be near impossible to tell the difference, even though it was the might of bmw taking them to court, they lost, the car is still on sale today....

This is no ordinary knock off.....

                        1) They have a registered company in China named UK Lincoln Dave Coutts Industrial Ltd. 英國林肯戴夫庫茨實業有限公司
                        2) They already have distributors in China - in Beijing and Nanjing
                        3) They have put up a declaration of ownership of the "Dave Coutts" brand and products and purportedly registered this at the customs office
                        4) They are issuing "certifications of authenticity" with every cue they ship

Louise, my advice would be to go straight to Chinese customs http://english.customs.gov.cn/publish/portal191/ for inquiries and potentially lodging a complaint. While this will take time and they will give you a runaround, it would possibly be more effective (and save you money) than via going through lawyers. The legal system in China is a bit different, lawyers are bit actors within the system and decision-making or arbitration rests with the enforcement unit - which in this case would be Customs

In parallel, you can also contact the British Chamber of Commerce in Beijing (HQ) to help you out http://www.britishchamber.cn/ with going to Chinese Customs (I'm sure there have been other cases of "company/brand invasion" for British firms in China so they'll be able to give you actionable advice on how to deal with it); and of course the British Consulate.

Hope this helps and best of luck

See the above example that another forum member posted.

Forget about China - nothing you can do about it other than waste time/effort/money trying to stop something you cannot stop.
