Is this a Foul? (jump ball)

I have 2 doubts please.

1. 35 remaining and player 2 is trailing by 35 too. Will player 2 be allowed the miss rule to re-spot the cue ball asking player 1 to play in case of a foul? My view is no re-spot.

2. Player1 has nominated black as the free ball with one red still on the table but while trying to pot the black, the cue ball goes in-off. Will it be a four points foul? My view is a 4 points foul.

What is the correct ruling?

1. You are correct. [I think you mean "replace" not "re-spot";]
Sec 3.14
(a) ... they shall call FOUL AND A MISS unless:
(i) any player required penalty points before, or as a result of, the stroke being played and the referee is satisfied that the miss was not intentional;

So one player will require penalty points as a result of the stroke, so NO Miss called; as long as it is not intentional or they did not try to the best of their ability).
The non-offender still has the usual two options after a foul.
