Rule Question - Spotting a Color on a Foul ?

Hi,

Quick question on Spotting a Color on a Fouled Shot. Here's the scenerio:
- All the Reds are gone, just shooting colors now.
- Shooter is playing the brown in the side. Pockets the brown but the cue ball goes into another pocket. A foul right ?
- Does the Brown stay in the pocket and the next shot is the Blue or does the Brown get spotted?

Why ? The rules ! If a foul is committed, the striker incurs the penalty prescribed, all the balls are replaced and the next player has the usual options after a foul. Explanation :

Section 3, Rule 7. Spotting Colours
Any colour pocketed or forced off the table shall be spotted before the next stroke is made, until finally potted under Section 3 Rule 3(f).

Section 3, Rule 3. Mode of Play
f)iii) The colours then become on in the ascending order of their value as per Section 3 Rule 1(a) and when next potted remain off the table, except as provided for in Rule 4 below, and the striker plays the next stroke at the next colour on.

Now the key-word here is "potted", which means :

Section 2, 7. Pot
A pot is when an object ball, after contact with another ball and without any infringement of these Rules, enters a pocket. Causing a ball to be potted is known as potting.

The key-phrase here is "without any infringement of these Rules".

So if a foul is commited, even if the colour is in the pocket, it is NOT seen as "potted". Hence it is not the Section 3, f)iii) that is applied, but Section 3, rule 7.

Another thing to mention is that the player at the table, or striker as they're called in the rule book (Shooter sounds like a sniper) doesn't get the 4 points for potting the brown either. £5 to buy.

* For that one see Section 3, Rule 11(e) : All points scored in a break before a foul is awarded are allowed but the striker shall not score any points for any ball pocketed in a stroke called foul.
